You are not required or encouraged to purchase any product or service in order to enter this Sweepstakes.
Eligibility: This Sweepstakes is open to legal residents of the fifty (50) United States and the District of Columbia who are 18 years of age or older as of the date of entry. The Sweepstakes is not open to employees, producers or directors of Rocket Munkee Productions and DataDirect Networks (collectively known as “Sponsorâ€) or any of their parent companies, affiliates, subsidiaries or advertising and promotion agencies, or members of their immediate families (spouse or parent, child or sibling or their respective spouses, regardless of where they reside) or households, whether or not related. VOID WHERE PROHIBITED. Sweepstakes is subject to all applicable federal, state and local laws. This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Youtube. You understand that you are providing your information to Sponsor and not to Youtube. The information that you provide will only be used in accordance with our Privacy Policy (http://www.watchsolo.com/privacy).
Sweepstakes Structure: The Promotion Period of this Sweepstakes begins at 12:01 a.m. Pacific Time (“PTâ€) on April 12, 2011 and ends at 5:00 p.m. PT on May 17, 2011 (the “Submission Periodâ€).
How to Enter: During The Promotion Period, you will need to: visit Sponsor’s WATCHSOLO YouTube channel at http://youtube.com/WATCHSOLO by logging on or follow the instructions provided to create a YouTube account during The Promotion Period. Once you are there do the following:
1. SUBSCRIBE to WatchSOLO on YouTube
2. “LIKE” each new episode (4, 5, 6, 7 and 8 )
3. ANSWER the Comment Question provided in the information section of each episode (“Submission”)
Participants may answer the Comment Question on one or all of the new episodes (including episodes 4, 5, 6, 7 and 8, but not including episode 1, 2, 3 or 9) for up to five (5) chances to win. You must be a member of YouTube to enter the Sweepstakes. Membership is free. You may leave one (1) comment per episode. There is a limit of one (1) Submission submitted per person and YouTube Account per new episode (4, 5, 6, 7 and 8). Submissions received from any person or email address in excess of the stated limitation will be void – so no need to submit multiple comments. Submissions generated by script, macro or other automated means and Submissions by any means, which subvert the entry process, will be void. All submissions become the property of the Sponsor and will not be returned.
Submission Guidelines: All Submissions should abide by YouTube’s Guidelines and Policies.
All Submissions should be in English. In the case of a video comment as a Submission, the video comment must be original work, true and verifiable, may not have been previously published, and must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. Video comments must also be in English (or subtitled in English). Submissions should not contain any of the following: * commercial endorsements, advertisements or solicitations; * content promoting alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); * content promoting any activities that may appear unsafe or dangerous; * content that is obscene or offensive; endorses any form of hate or hate group; * content that defames, misrepresents or contains disparaging remarks about other people or companies; * content that communicates messages or images inconsistent with the positive images and/or good will to which we wish to associate; * content that is unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate; and/or * content that violates any law, or is obscene or inappropriate, as determined by Sponsor in its sole opinion. Sponsor may disqualify and delete any Submission for any reason, in its sole and absolute discretion, including for violating any of the foregoing Submission Guidelines.
By entering a Submission into the Sweepstakes, entrant hereby grants permission for the Submission to be posted on http://youtube.com/WATCHSOLO or other websites. Entrant agrees that Released Parties (as defined below) are not responsible for any unauthorized use of Submissions by third parties. Released Parties do not guarantee the posting of any Submission. Entrants agree that they will not use the Submission for any other purpose, including without limitation, posting the Submission to any other online social networks, without the express consent of the Sponsor in each instance.
Any Submission that does not comply with the requirements set forth in these Terms & Conditions may be disqualified.
Participant acknowledges and agrees that the Sponsor does not have now, nor shall it have in the future, any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of any copyright in and to participant’s Submission.
Sponsor has no right to exploit or otherwise use the Submissions except in accordance with these Terms & Conditions.
No Obligation to Proceed: Upon review of the Submissions, Sponsor may eliminate participant from the Sweepstakes in its sole discretion. Sponsor may also require participant to bring the Submission into compliance with any requirements of the Sweepstakes, including any guidelines provided by Sponsor. All decisions regarding the Sweepstakes, including without limitation, eligibility, participant selection, the acceptability of Submissions and participant elimination, are at Sponsor’s sole and exclusive discretion, and are final and not subject to appeal.
Winner Selection: Sponsor will randomly select one (1) potential Sweepstakes Winner for each new episode (4 through 8), from all eligible entries received during the applicable Submission Period, for a total of five (5) potential Winners. One (1) potential Winner will be chosen from each particular episode’s comment section, one (1) winner per episode. Participants may comment on one (1) or all of the new episodes, for up to five (5) chances to win. However, a participant may only win once. The Winners will be chosen on or around May 17, 2011. Each of the five (5) potential Winners will be awarded one (1) Apple TV. Prize award is subject to verification of eligibility and compliance with these Terms & Conditions.
Sponsor reserves the right not to select any Winner if, in its sole discretion, it does not receive a sufficient number of eligible and/or qualified Submissions during The Promotion Period. Sponsor reserves the right, in its sole discretion, to disqualify any participant that it finds has tampered with, or has attempted to tamper with, the submission process or the operation of the Sweepstakes, or to be in violation of these Terms & Conditions or who has acted in a disruptive or unsportsmanlike manner and void the associated Submissions.
Sponsor also reserves the right to conduct a background check to help ensure that participant’s continued participation in the Sweepstakes will not, in Sponsor’s sole discretion, bring Sponsor into disrepute, contempt, scandal or ridicule, or otherwise reflect unfavorable on Sponsor or this Sweepstakes
Participant’s Submission to the Sweepstakes constitutes participant’s permission for Sponsor to conduct such background check, provided that, to the extent additional authorization is necessary under law, participant shall authorize such check. Sponsor reserves the right (at its sole discretion) to disqualify any entrant based on the results of the background check or failure of the entrant to properly authorize such check.
ALL DECISIONS OF SPONSOR ARE FINAL AND BINDING.
Winner Notification: Sponsor will notify the potential five (5) Winners by e-mail via the potential winner’s YouTube account and each Winner may be required to complete an Affidavit of Eligibility, Liability and Publicity Release (unless prohibited by law) and any other documents required by Sponsor, which must be returned within three (3) business days of notification to be eligible for the Prize. Any applicable required documents will be provided with the email notification, as well as instructions/options on returning the documents in a timely manner. Return of prize or prize notification as undeliverable, failure to sign and return requested documentation within the specified time period, the inability of Sponsor to contact a potential winner within a reasonable time period or noncompliance with these Terms & Conditions by any potential winner will result in disqualification and, at Sponsor’s sole discretion, the prize may be awarded to a runner-up. Released Parties shall not be liable for (i) failed, returned or misdirected notifications due to inaccurate information provided by a participant, or (ii) responses to notifications which are lost, late, incomplete, illegible, unintelligible, misdirected, damaged or otherwise not received, in whole or in part, by Sponsor. If any Winner is at least 18 but still considered a minor in his/her jurisdiction of residence, Sponsor may, at its discretion, require his/her parent or legal guardian to execute all required documents on behalf of potential Winner, who will be responsible for fulfilling all requirements imposed on winner set forth herein.
Five (5) Grand Prizes: Each of the five (5) Winners will receive one (1) Apple TV. Approximate Retail Value (“ARVâ€) of the prize is $99. Prize is awarded “as is†with no warranty or guarantee, either express or implied by Sponsor. Winner may not substitute, assign or transfer prize or redeem prize for cash, but Sponsor reserves the right, at its sole discretion, to substitute prize (or portion thereof) with one of comparable or greater value. If a winner cannot accept prize as stated, prize will be forfeited and, at Sponsor’s discretion, an alternate runner-up will be selected. By participating in this Sweepstakes, you hereby agree to release and hold Sponsor and their respective parent companies, subsidiaries, affiliates and advertising and promotion agencies and all of their respective officers, directors, employees, shareholders, licensees and agents (collectively, “Released Partiesâ€) harmless from any and all claims, liabilities, damages, losses, costs and expenses, including attorneys’ fees and costs, arising in whole or in part, directly or indirectly, from your participation in the Sweepstakes or any Sweepstakes-related activity or acceptance, possession, use or misuse of the prize.
You further agree to indemnify, defend, and hold Released Parties harmless from and against any third party claims, liabilities, damages, losses, costs and expenses, including attorneys’ fees and costs, arising from or relating to this Sweepstakes or any Released Party’s use of the Submission in accordance with the rights granted herein. Released Parties are not responsible for lost, late, misdirected, damaged, stolen, altered, garbled, incorrect, incomplete, delayed or undelivered Submissions; all of which will be void. Released Parties are also not responsible for problems uploading or downloading any Sweepstakes-related information or materials from the Site or for any other technical malfunctions of electronic equipment, computer online systems, servers, or providers, computer hardware or software failures, phone lines, failure of any Submission to be received by Sponsor on account of technical problems, traffic, congestion on the internet or the Site, or for any other technical problems including telecommunication, miscommunication or failure, and failed, lost, delayed, incomplete, garbled or misdirected communications which may limit participant’s ability to participate in this Sweepstakes.
Released Parties are not responsible for any other errors or malfunctions of any kind, whether network, printing, typographical, human or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or malfunctions which may occur in connection with the administration of the Sweepstakes, the processing or judging of Submissions, the incorrect uploading of Submissions, the announcement of the Winner or in any Sweepstakes-related materials. In the event of a dispute regarding online Submissions received from multiple users having the same e-mail account, the authorized subscriber of the e-mail account at the time of Submission will be deemed to be the participant and he/she must comply with these Terms & Conditions. Authorized subscriber is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), online service provider, or other organization responsible for assigning e-mail addresses. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the Submission process or the operation of the Sweepstakes or any website, intending to annoy, abuse, threaten or harass any other participant, Sponsor or any of its representatives or to otherwise be acting in violation of these Terms & Conditions and void all associated Submissions.
Sponsor reserves the right to suspend, modify or cancel Sweepstakes, or any participant’s participation in this Sweepstakes, at any time in its sole discretion if a computer virus, worms, bug, non-authorized intervention or other problem corrupts the administration or security of this Sweepstakes, or for any other reason and, if this Sweepstakes is canceled, to select the Winner from among the non-suspect, eligible entries received during The Promotion Period prior to the cancellation date using the selection procedure set forth herein.
CAUTION: Any attempt by a participant to deliberately damage any website or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek damages (including Attorney’s fees) from any such participant to the fullest extent permitted by law and to disqualify such participant from the Sweepstakes.
